Important consent notice
These terms become part of your marketing consent when a PodPitch form, page, event registration, account flow, written agreement, or other consent request links to these terms and asks you to agree to receive PodPitch marketing emails. Please read them before agreeing.
Acceptance and scope
By affirmatively choosing to receive PodPitch marketing emails, including by selecting an unchecked consent box, clicking a clearly labeled subscription button, submitting a dedicated email signup form, signing a written consent, or providing another legally valid affirmative indication, you agree to these Email Marketing Consent Terms.
Your consent is specific to marketing by PodPitch and Magic Pitch Enterprises Inc. It covers email only. It does not, by itself, authorize marketing telephone calls, SMS or MMS text messages, push notifications, or marketing by an unrelated third party.
These terms supplement the disclosure shown at the place where you consented, the PodPitch Privacy Notice, and any other terms that expressly apply to the interaction. If the shorter disclosure at the point of consent provides a narrower scope, the narrower scope controls.
Who will contact you
The sender is Magic Pitch Enterprises Inc., doing business as PodPitch. References to "PodPitch," "we," "us," and "our" in these terms mean Magic Pitch Enterprises Inc. and the personnel and service providers acting on its behalf.
Emails may identify the sender as PodPitch, Magic Pitch Enterprises Inc., a PodPitch team member, or another clearly disclosed PodPitch brand or program. Your consent does not permit an unrelated company to use your email address for its own independent marketing merely because that company supplies software or services to PodPitch.
Emails you may receive
Your consent permits PodPitch to send marketing and promotional emails that may include:
- News about PodPitch products, services, features, releases, improvements, and availability.
- Podcast publicity, earned media, public relations, audience growth, and business development tips.
- Newsletters, educational resources, guides, reports, case studies, webinars, events, and invitations.
- Offers, discounts, trials, upgrades, renewals, referral programs, and other promotions.
- Demo invitations, sales follow-ups, product recommendations, and information based on interests you shared with us.
- Surveys, feedback requests, reviews, customer stories, and requests to participate in research.
- Re-engagement, win-back, cart or signup follow-up, and reminders about an incomplete marketing or purchase journey, where permitted by law.
- Other PodPitch marketing that is reasonably related to the products, services, content, and business purposes described above.
Marketing emails may contain commercial content and calls to action. They may be sent to prospective customers, current customers, former customers, trial users, event participants, newsletter subscribers, and other people who have validly consented.
Frequency and automation
PodPitch may send marketing emails on a recurring basis. Message frequency is not fixed and may vary based on your relationship with PodPitch, your stated interests, your activity, the programs you join, and the campaigns operating at a given time.
Emails may be selected, personalized, scheduled, and sent using automated systems. Automation may determine whether, when, and which marketing email you receive. PodPitch remains responsible for its marketing even when software helps prepare or deliver it.
Email platforms and service providers
You are consenting to receive marketing from PodPitch, not from a particular software platform. PodPitch may create, manage, personalize, send, route, and measure its marketing using any email delivery, customer relationship management, marketing automation, analytics, customer engagement, or infrastructure provider that PodPitch selects now or in the future.
These providers may include platforms such as Klaviyo, HubSpot, Resend, and other vendors that perform similar functions. PodPitch may change providers, use more than one provider at the same time, migrate subscriber records between providers, or send different campaigns through different providers without requesting new consent solely because the technology provider changed.
To perform these services, providers may process information such as your name, email address, company, role, preferences, subscription status, consent record, and interactions with PodPitch emails. They may process this information only as permitted by applicable law, their agreements with PodPitch, and the PodPitch Privacy Notice. A provider does not receive permission to market its own unrelated products to you merely by processing PodPitch email.
Personalization and measurement
PodPitch may tailor marketing based on information you provide, your relationship with us, the pages or resources you visit, prior communications, account or purchase history, professional interests, company information, and other information lawfully available to PodPitch.
Marketing emails may use links, pixels, and similar technologies to help PodPitch understand delivery, opens, clicks, conversions, device or browser information, and engagement. These tools help us operate campaigns, measure effectiveness, prevent abuse, and improve content. Where separate consent is legally required for a particular tracking technology, PodPitch will seek it or disable that technology as required.
Your choice to consent
Agreeing to marketing emails is voluntary. Consent is not a condition of buying a PodPitch product, receiving contracted services, creating an account, obtaining support, booking a demo, or completing another transaction unless the service you request is itself an email marketing subscription, such as a newsletter.
Refusing or withdrawing marketing consent will not remove rights or services you have already purchased. It may mean that you do not receive promotional pricing, marketing-only resources, invitations, or other benefits offered through the email program.
Duration of consent
Unless the consent request states a shorter period, your consent continues until you withdraw it, PodPitch ends the relevant email program, the consent is no longer valid under applicable law, or PodPitch determines that the address should no longer receive marketing.
PodPitch may periodically ask you to confirm or refresh your consent, especially after a long period without engagement, when required by law, or when the nature of the marketing materially changes. PodPitch may also suppress inactive or high-risk addresses without notice to protect recipients and email deliverability.
Unsubscribing and withdrawal
You may withdraw your marketing consent at any time. Use the unsubscribe link in a PodPitch marketing email or email hi@podpitch.com with your request. Unsubscribing is free other than ordinary costs of internet access.
PodPitch will process withdrawal requests promptly and within the period required by applicable law. Some campaigns are prepared in advance, so you may receive a message already in process before the withdrawal is fully applied. PodPitch may retain a limited suppression record so that it can honor your request and avoid adding the address back to marketing lists by mistake.
If you use more than one email address, unsubscribe each address you no longer want PodPitch to market to. Preference options may let you reduce certain categories or frequencies without ending all PodPitch marketing, but every marketing email will offer a way to stop all applicable marketing emails.
Service and transactional messages
Withdrawing marketing consent does not prevent PodPitch from sending non-marketing messages that are necessary to provide a product or service, administer an account, complete a transaction, respond to a request, provide security or legal notices, collect an amount due, or otherwise communicate for a non-marketing purpose permitted by law.
PodPitch will not treat promotional content as transactional merely to avoid an unsubscribe request. When a message combines different types of content, PodPitch will classify and handle it according to applicable law.
Privacy and data handling
PodPitch handles personal information associated with marketing consent as described in the PodPitch Privacy Notice. The Privacy Notice explains the categories of information collected, the purposes for processing it, disclosures to service providers and business partners, retention, security, cross-border processing, and privacy rights that may apply to you.
Review the current PodPitch Privacy Notice. Consent to marketing is separate from acknowledgement of the Privacy Notice. The Privacy Notice describes our practices; the affirmative action at the point of signup establishes your marketing choice.
International recipients
Marketing rules differ by country and region. PodPitch will apply these terms subject to mandatory local law. Nothing in these terms limits a right that cannot legally be waived, including rights concerning consent, access, correction, deletion, objection, restriction, complaints, or withdrawal.
For recipients in Canada, Magic Pitch Enterprises Inc. is the person seeking consent, the purpose is to send the PodPitch marketing described in these terms, and consent may be withdrawn using the methods in Section 9. The company contact details are listed in Section 17.
For recipients in the European Economic Area, Switzerland, and the United Kingdom, PodPitch will rely on consent or another lawful basis only where permitted. Where marketing is based on consent, you may withdraw that consent at any time without affecting the lawfulness of processing that occurred before withdrawal.
Consent records
PodPitch may retain evidence of your consent, including the email address, date and time, source, form or page, disclosure and terms version, affirmative action, technical information reasonably associated with the signup, confirmation status, and later preference or withdrawal events.
These records may be stored by PodPitch or its service providers and may be used to administer preferences, answer questions, investigate complaints, demonstrate compliance, prevent fraud or list abuse, and enforce these terms. Moving the record to a different email platform does not change the underlying consent or its scope.
Changes to these terms
PodPitch may update these terms to improve clarity, reflect changes in law, identify new contact information, or describe changes in the tools used to deliver substantially the same PodPitch marketing. The effective date at the top will show when the current version took effect.
A change in email or CRM provider does not, by itself, require new consent. PodPitch will not use a later version of these terms to retroactively expand your consent to a materially different sender, communication channel, or purpose where new consent is required by law. If a change requires a new affirmative choice, PodPitch will ask for it.
General terms
If a provision of these terms is found unenforceable, it will be enforced to the greatest extent permitted and the remaining provisions will continue to apply. A delay in exercising a right does not waive that right. These terms do not reduce any non-waivable consumer or privacy protection.
These terms concern email marketing consent only. PodPitch's general Terms of Service govern use of PodPitch products and websites where applicable. The laws of the State of New York govern these terms to the extent that they are not displaced by mandatory law in your place of residence.
